Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the websites, mobile applications, and services operated by SilkenAura Bodycon Fabric Ltd (“SilkenAura,” “we,” “our,” or “us”), including any products, content, tools, and related offerings (collectively, the “Services”).
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility & Account Responsibility
1.1 Eligibility
You must be at least the minimum legal age in your jurisdiction to use our Services. If you are under the age of majority, you may only use the Services under the supervision and consent of a parent or legal guardian.
1.2 Account Creation
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.
1.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You must notify us immediately if you suspect unauthorized access or misuse.
2. Use of Services
2.1 Permitted Use
You may use the Services only for lawful purposes and in accordance with these Terms.
2.2 Prohibited Conduct
You agree not to:
- Use the Services for unlawful, fraudulent, or malicious activities
- Violate or attempt to violate the security of the Services
- Upload or transmit viruses, malware, or harmful code
- Interfere with the operation, performance, or security of the Services
- Attempt unauthorized access to any systems, accounts, or data
- Use scraping, bots, automation, or data mining without permission
- Harass, abuse, threaten, impersonate, or intimidate others
- Infringe on intellectual property rights
We may suspend or terminate access if we reasonably believe prohibited conduct has occurred.
2.3 Privacy & Data Processing
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and store your personal information.
By accessing or using the Services, you consent to our collection and processing of your information in accordance with our Privacy Policy and applicable privacy laws. If you do not consent, you must stop using the Services.
We may use cookies, analytics tools, and similar technologies to operate, improve, and secure the Services. You may be able to adjust certain settings through your browser or device, but disabling these features may affect functionality.
2.4 User Content & Community Features (If Applicable)
If the Services allow you to submit, upload, publish, or share any content (including reviews, comments, images, messages, or other materials) (“User Content”):
- You retain ownership of your User Content.
- You grant SilkenAura a worldwide, non-exclusive, royalty-free license to use, reproduce, display, distribute, modify, and publish your User Content solely for operating, promoting, and improving the Services.
- You represent and warrant that you have all rights necessary to submit the User Content and that it does not infringe third-party rights or violate any laws.
- We reserve the right (but are not obligated) to remove, restrict, or delete User Content at any time, with or without notice, if we believe it violates these Terms or may cause harm or legal risk.
3. Products, Orders & Transactions
3.1 Product Information
We strive to display accurate product descriptions, images, specifications, and pricing. However, product appearance may vary slightly due to manufacturing differences, lighting, photography, or screen settings.
3.2 Product Availability
All products are subject to availability. We reserve the right to discontinue any product, update product information, or limit quantities without notice.
3.3 Pricing & Errors
Prices may change at any time. While we make reasonable efforts to ensure accuracy, errors may occur in pricing or product listings. If an error is identified, we reserve the right to correct it and cancel or refuse any order.
3.4 Order Acceptance
Placing an order does not guarantee acceptance. We reserve the right to cancel or refuse any order at our discretion, including but not limited to orders affected by:
- Product unavailability
- Pricing or listing errors
- Payment authorization failure
- Suspected fraud or misuse
- Shipping limitations
If we cancel an order after payment, we will issue a refund where applicable.
3.5 Payment Processing
Payments are processed through Stripe or other authorized payment processors. By purchasing through our Services, you agree to Stripe’s terms and policies and any applicable payment provider requirements.
4. Shipping & Delivery Policy (Shipping, Delivery & Risk)
4.1 Shipping Coverage
SilkenAura ships to eligible regions as shown during checkout. Shipping availability may vary depending on carrier service coverage, customs restrictions, and operational limitations.
4.2 Shipping Timeframes
Shipping and delivery timeframes shown in the Services are estimates only. Delivery may be affected by factors outside our control, including carrier delays, weather conditions, customs processing, public holidays, and disruptions in logistics networks.
4.3 Shipping Rates
Shipping costs are displayed during checkout. Shipping fees may vary depending on destination, order weight, shipping method, and promotional campaigns.
4.4 Delivery Responsibility
You are responsible for providing accurate and complete shipping information. SilkenAura is not responsible for delivery failures caused by:
- Incorrect or incomplete delivery information provided by you
- Unavailability of the recipient at the time of delivery
- Refusal of delivery by the recipient
- Failed delivery attempts by the carrier
If an order is returned due to incorrect address details or delivery refusal, reshipping fees may apply.
4.5 Risk of Loss
Risk of loss transfers to you once the shipment has been handed over to the carrier, unless otherwise required by applicable law.
4.6 Customs, Duties & Taxes (International Orders)
If you place an order for delivery outside Canada, your shipment may be subject to import duties, taxes, customs fees, and additional charges imposed by your local government. These costs are your responsibility unless otherwise stated.
We are not responsible for delays, holds, confiscations, or return-to-sender actions caused by customs clearance or government processing.
4.7 Shipping Exceptions and Service Interruptions
SilkenAura may delay, cancel, or modify shipping services due to operational limitations, supply chain disruptions, force majeure events, or carrier restrictions.
5. Return, Refund & Chargeback Policy
5.1 No Standard Return Feature
SilkenAura does not provide an automated or standard return feature through the Services. Returns and refunds are not guaranteed and are handled only through customer support review.
5.2 Refund & Return Requests
If you wish to report an issue, request a return, or request a refund, you must contact SilkenAura Support at:

Requests must include:
- Order number
- Proof of purchase
- Clear explanation of the issue
- Photos/videos where relevant (e.g., damage, defect)
5.3 Return Eligibility (Case-by-Case Review)
Return or refund eligibility is determined on a case-by-case basis based on:
- The nature of the issue
- Proof of purchase verification
- Product condition and usage status
- Whether the issue is reported within a reasonable timeframe
- Applicable consumer protection laws
- Operational feasibility and return logistics
SilkenAura reserves the right to refuse return or refund requests if the claim cannot be verified or if it falls outside applicable legal requirements.
5.4 Non-Returnable / Non-Refundable Cases
Unless required by law, SilkenAura may refuse returns or refunds for:
- Products that appear used, washed, altered, or damaged after delivery
- Products damaged due to misuse, negligence, or improper handling
- Orders delivered successfully as confirmed by carrier tracking
- Minor variations in color, texture, or appearance due to lighting or screens
- Requests made after an unreasonable period without valid justification
- Promotional items marked “Final Sale” (where legally enforceable)
5.5 Return Instructions (If Approved)
If a return is approved, you must follow the exact return instructions provided by SilkenAura Support. Failure to follow instructions may result in denial or cancellation of the return/refund request.
5.6 Refund Processing
If a refund is approved:
- Refunds are processed through Stripe (or other payment provider) to the original payment method
- Refund processing timelines depend on your bank and payment provider
- Refund settlement may take 10–15 business days, and in some cases longer
- Shipping fees are non-refundable unless required by law or explicitly approved by SilkenAura
5.7 Partial Refunds
SilkenAura may issue partial refunds where applicable, including but not limited to:
- Products returned with missing packaging or components
- Products returned in a reduced-value condition
- Cases where part of an order is refunded and part remains valid
5.8 Chargebacks, Fraud, and Dispute Abuse
SilkenAura reserves the right to deny, limit, or reverse a refund request where permitted by law if we reasonably determine that:
- The order or refund request is associated with fraud, misuse, or abuse
- A chargeback or payment dispute has been initiated
- The claim is inconsistent with our records, delivery confirmation, or verification checks
- The request violates these Terms or payment processor policies
If a chargeback is initiated without first contacting SilkenAura Support, we may:
- Suspend or terminate the associated account
- Restrict future purchases
- Submit evidence and dispute records to the payment provider
5.9 Dispute Resolution Before Legal Action
Before initiating a legal dispute, chargeback, or claim, you agree to contact SilkenAura Support and allow at least 30 days for resolution attempts.
Nothing in this section limits any mandatory consumer rights applicable in your jurisdiction.
6. Account Deletion
6.1 User-Initiated Account Deletion
Users may delete their account at any time through the Services (where available) or by submitting a deletion request to SilkenAura Support.
Once an account deletion request is submitted and accepted:
- The deletion is permanent and cannot be undone or restored.
- Personal information, billing information, shipping information, order history, wishlist data, credentials, and profile information will be permanently deleted and cannot be recovered.
You acknowledge that once deleted, your account and all associated information will no longer be accessible.
6.2 Restrictions on Account Deletion
You may not be able to delete your account if:
- You have any order in “Processing” status, or
- A refund is pending or in progress for your account
Once there are no active processing orders and no refunds pending or in progress, you may delete the account instantly.
SilkenAura may delay deletion only to the extent required to:
- complete active processing orders
- complete refund settlement
- comply with legal obligations
6.3 Effect of Account Deletion
Upon deletion, your personal information and account data described above will be permanently removed as set out in our Privacy Policy.
7. Order Cancellation
7.1 Order Cancellation
Order cancellation may not be available through the mobile application.
If you wish to cancel an order, you may:
- Cancel the order through our website (where available), or
- Submit a cancellation request to SilkenAura Support at: contact@silkenaura.ca
SilkenAura may cancel an order at its discretion for reasons including product availability, payment issues, suspected fraud, or operational limitations.
7.2 Refund Initiation Following Cancellation
If an order is canceled by you or by SilkenAura, a refund request will be initiated where applicable and processed through our payment provider.
7.3 Refund Timing
Refund processing depends on your bank, card issuer, and payment provider. Once initiated, refunds may take 10–15 business days to appear in your account, and in some cases may take longer depending on the payment institution.
8. Intellectual Property
All content on the Services, including trademarks, product images, designs, logos, website/app content, and software, is owned by or licensed to SilkenAura and protected under applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, resell, or exploit any content without written permission.
9. Third-Party Services
The Services may contain links to, or integrations with, third-party services (including payment processors and shipping partners). SilkenAura is not responsible for third-party content, services, practices, or policies.
Your use of third-party services is at your own risk and may be governed by third-party terms.
10. Termination & Suspension
We may suspend or terminate your access immediately and without notice if:
- You violate these Terms
- We suspect fraud, misuse, or unlawful activity
- We are required to do so by law
- continued access poses a risk to system security or operations
You may stop using the Services at any time and may request account deletion as described above.
10.1 Survival
Any provisions that by their nature should survive termination—including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute terms will survive termination and remain enforceable.
11. Disclaimers
To the maximum extent permitted by law:
- The Services and products are provided “AS IS” and “AS AVAILABLE.”
- We do not guarantee uninterrupted access, error-free performance, or continuous availability
- . We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement
Some jurisdictions may not allow certain disclaimers. In such cases, disclaimers apply only to the extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, SilkenAura and its affiliates, directors, officers, employees, and suppliers shall not be liable for:
- indirect, incidental, special, consequential, or punitive damages
- loss of profits, revenue, data, or goodwill
- damages arising from your use or inability to use the Services
- third-party service failures, shipping delays, customs issues, or carrier disputes
If liability cannot be excluded, SilkenAura’s maximum aggregate liability will not exceed the total amount you paid to SilkenAura in the three (3) months preceding the claim, or CAD $100, whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold harmless SilkenAura and its affiliates, officers, employees, partners, and service providers from any claims, damages, losses, liabilities, and legal costs arising from:
- Your violation of these Terms
- Your misuse of the Services
- Your infringement of any rights of another person or entity
14. Force Majeure
SilkenAura will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, labor strikes, customs delays, supply chain interruptions, government actions, internet or hosting failures, power outages, or shipping carrier disruptions.
If such events occur, we may suspend or limit Services or fulfillment without liability for the duration of the event.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of Canada and the laws of the Province of British Columbia, without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts located in British Columbia, Canada, unless otherwise required by applicable consumer protection laws.
16. Changes to Terms
We may update these Terms periodically. Updated versions will be posted with a revised effective date. Continued use of the Services after updates constitutes acceptance of the revised Terms.
17. Electronic Communications & Notices
By using the Services, you consent to receiving electronic communications from SilkenAura, including account-related notices, receipts, order confirmations, and legal notices.
We may deliver notices via email, SMS, in-app notification, or by posting notices on the Services. Notices are considered delivered on the date they are sent or posted.
18. App Store Disclaimer (Mobile App Users)
If you access the Services through a mobile application downloaded from Apple’s App Store or Google Play:
- These Terms are between you and SilkenAura, not Apple or Google.
- Apple and Google are not responsible for the Services or for resolving disputes related to the Services.
- To the maximum extent permitted by law, Apple and Google have no warranty obligations regarding the Services.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and enforceable.
20. Entire Agreement
These Terms, together with any policies referenced (including the Privacy Policy), constitute the entire agreement between you and SilkenAura and supersede all prior agreements or communications.
